What is the Affordable Care Act?

The Affordable Care Act (ACA), also known as “Obamacare,” is a federal law signed in 2010 that transformed the way Americans access health insurance. Its central promise is straightforward: no one can be denied coverage or charged more because of a pre-existing condition.

Under the ACA, health plans sold on the federal and state Marketplaces must cover a set of 10 essential health benefits, including:

  • Ambulatory (outpatient) care
  • Emergency services
  • Hospitalization
  • Maternity and newborn care
  • Mental health and substance use disorder services
  • Prescription drugs
  • Rehabilitative services and devices
  • Laboratory services
  • Preventive and wellness services (including chronic disease management)
  • Pediatric services, including dental and vision

These protections apply whether you’re buying coverage for yourself, your family, or a small group — and whether you enroll through HealthCare.gov, a state Marketplace, or through a licensed agent like Maher Insurance Group.

Who Qualifies for ACA Coverage?

Almost every U.S. citizen and legal resident qualifies for ACA Marketplace coverage. There is no health screening, no medical underwriting, and no denial for pre-existing conditions. Key eligibility requirements include:

  • U.S. citizen or lawfully present — You must live in the United States and be a citizen, national, or lawfully present immigrant.
  • Not currently incarcerated — Individuals who are incarcerated are not eligible to enroll through the Marketplace.
  • Not eligible for Medicare — If you already have Medicare, you generally cannot purchase a Marketplace plan. However, your spouse or dependents may still qualify.

If you have employer-sponsored coverage, you may still be eligible for a Marketplace plan — especially if your employer’s plan is considered unaffordable (premiums exceed a certain percentage of your household income).

Open Enrollment & Special Enrollment Periods

ACA coverage follows an annual enrollment cycle. Understanding the timing is critical — miss the window and you may have to wait until the following year.

Open Enrollment Period (OEP)

Open Enrollment typically runs from November 1 through January 15 each year for most states (some state-based Marketplaces have extended deadlines). During this window, anyone can apply, compare plans, and enroll — no qualifying event required.

Special Enrollment Period (SEP)

Outside of Open Enrollment, you can still enroll if you experience a qualifying life event. Common qualifying events include:

  • Loss of existing health coverage (job loss, aging off a parent’s plan, COBRA expiration)
  • Marriage, divorce, or legal separation
  • Birth or adoption of a child
  • Moving to a new state or coverage area
  • Change in household income that affects subsidy eligibility
  • Gaining citizenship or lawful presence

Understanding ACA Plan Tiers

All Marketplace plans are organized into four metal tiers. The tier you choose affects your monthly premium, deductible, and out-of-pocket costs. Every tier covers the same essential health benefits — the difference is how you and the plan split costs.

Premium Tax Credits & Subsidies

One of the ACA’s most impactful provisions is the Premium Tax Credit (PTC) — a federal subsidy that lowers your monthly premium based on your household income. Millions of Americans qualify, and many don’t realize it.

How subsidies work

  • Income-based: If your household income falls between 100% and 400% of the Federal Poverty Level (FPL), you likely qualify. Under the current enhanced subsidies (extended through 2025), even some higher-income households are eligible.
  • Applied at enrollment: You can take the credit in advance to reduce your monthly premium, or claim it when you file your taxes.
  • Varies by location: Subsidy amounts depend on where you live, your age, your household size, and the cost of the benchmark Silver plan in your area.

Cost-Sharing Reductions (CSR)

If your income is between 100% and 250% of FPL and you choose a Silver plan, you may also qualify for Cost-Sharing Reductions that lower your deductible, copays, and out-of-pocket maximum — without raising your premium.
